General Terms and Conditions
1 - Products
The Maison Massillon site offers head jewelry and entirely handmade accessories. The creations are the property of the creator of the Maison Massillon brand.
2 - Price
The prices are indicated in euros (EUR) and are only valid on the date of ordering. The prices displayed do not include shipping costs, invoiced in addition to the price of products purchased as indicated when ordering and the prices in force.
3 - Orders
To order an article, just select it and then on the description page of this product, click on Add to Cart so it will be added to the basket (visible at the top right). You can at this stage continue your purchases or finalize your order. If this is the case you will be redirected to the summary of your order. You will then have to choose your delivery country and then validate by clicking on Check Out. Your contact details will be requested at this stage.
4 - Payment
Payment is made by bank card via the fully secure platform of Shopify.com. It is not necessary for you to have a PAYPAL account to make your payment.
5- Delai, delivery and shipping costs
Orders placed on the online store are shipped to mainland France and abroad. Upon receipt of payment, your order is definitively registered. The delivery of your items is made within 3 working weeks maximum. The shipping costs vary from € 3 to 20 € depending on the weight and volume of the items ordered and the shipping method. This amount has been configured for each item, so as to reflect the real shipping costs as much as possible (port and packaging) The amount of shipping costs will be indicated to you on the page "my basket", when you have added a or several articles. Select "France" for the destination country then click on "Updating".
6 - Exchange and refund
Pursuant to article L.120-20 of the Consumer Code, the buyer has a period of 14 working days to return to his expense, the items that do not suit him, for an exchange or a refund. This period runs from the day of receipt of the order. Any return must be reported beforehand by email to: contact@maisonmassillon.com
Courrons or tailor -made or personalized accessories may not be reimbursed.
This right of withdrawal is exerted without penalty, with the exception of shipping and return costs. The items will have to be returned to their original packaging, in perfect state of resale. Otherwise, the products will not be reimbursed, taken up, or exchanged. In the event of the exercise of the right of withdrawal, the buyer has the choice to request either the reimbursement of the sums paid or the exchange of the product.
7- Intellectual ownership
Any reproduction or use without authorization of the texts, comments and photographs used on the site www.maisonmassillon.com are strictly prohibited. (art. 4. 335-3).
8 - Guarantee
All items for sale on the website benefit from the legal guarantee of compliance (provided for in articles L211-1 and following the Consumer Code) and the guarantee against hidden defects (articles 1641 and following of the Civil Code), excluding any other guarantee. You are informed that the company Massillon, whose head office is 229 rue Saint Honoré, 75001 Paris, is the guarantor of the compliance of articles to the contract within the framework of these two legal guarantees.
This legal warranty allows you to return the articles delivered defective or non-compliant, for reimbursement under the conditions referred to below:
Unless he is a legal person or a natural person acting for purposes in the context of his commercial, industrial, craft or liberal activity, the customer benefits in any event from the legal guarantees on the basis of which he can act. Massillon is thus required of compliance defects and hidden defects under the conditions provided respectively by articles L 217-4 and following of the Consumer Code and 1641 and following of the Civil Code.
Article L 217-4 of the Consumer Code: The seller is required to deliver good to the contract and responds to existing compliance defects during issuance. He also responds to compliance defects resulting from the packaging, assembly instructions or installation when it has been charged by the contract or was carried out under his responsibility.
Article L 217-5 of the Consumer Code: To comply with the contract, the property must: 1 ° be specific to the usually expected use of a similar property and, if applicable:-correspond to the description given by the seller and have the qualities that he presented to the buyer in the form of a sample or model; - present the qualities that a buyer can legitimately expect having regard to public declarations made by the seller, by the producer or by his representative, in particular in advertising or labeling; 2 ° or present the characteristics defined by mutual agreement by the parties or be specific to any special use sought by the buyer, brought to the attention of the seller and which the latter accepted.
Article L 217-7 of the Consumer Code: The defects of conformity which appear within twenty-four months from the issuance of the property are presumed to exist at the time of deliverance, unless proven otherwise. The seller can fight this presumption if it is not compatible with the nature of the property or the lack of conformity invoked.
Article L 217-9 of the Consumer Code: In the event of a lack of conformity, the buyer chooses between the repair and the replacement of the property. However, the seller may not proceed according to the choice of the buyer if this choice results in a manifestly disproportionate cost with regard to the other modality, taking into account the value of the property or the importance of the defect. It is then required to proceed, except impossibility, according to the modality not chosen by the buyer.
Article L 217-10 of the Consumer Code: If the repair and replacement of the property are impossible, the buyer can make the property and be returned the price or keep the property and have part of the price. The same faculty is open to him: 1 ° if the solution requested, proposed or agreed in application of article L. 217-9 cannot be implemented within one month of the buyer's complaint; 2 ° or if this solution cannot be without major drawbacks for it given the nature of the property and the use it seeks. The resolution of the sale cannot however be pronounced if the lack of conformity is minor.
Article L 217-11 of the Consumer Code: The application of the provisions of articles L. 217-9 and L. 217-10 takes place at no cost for the buyer. These same provisions do not preclude damages allocation.
Article L 217-12 of the Consumer Code: The action resulting from the lack of conformity is prescribed by two years from the issuance of the property.
Article L 217-16 of the Consumer Code: When the buyer requests the seller, during the price of the commercial guarantee which was granted to him when the acquisition or repair of a furniture is acquired, a repair covered by the guarantee, any period of immobilization of 'At least seven days is added to the duration of the guarantee that remained to run. This period runs from the buyer's intervention request or the provision for repairing the property in question, if this provision is after the request for intervention.
Article 1641 of the Civil Code: The seller is held from the guarantee due to the hidden defects of the thing sold which make it unfit for the use to which it is destined, or which decreases this use so much, that the buyer would not have acquired it, or would have given a lower price, if he had known them.
Article 1644 of the Civil Code: Dyears the case of articles 1641 And 1643, the buyer has the choice to return the thing and be returned the price, or to keep the thing and have part of the price.
Article 1648, paragraph 1, of the Civil Code: The action resulting from crippling vices must be brought by the buyer within two years from the discovery of the vice.
When it acts as a legal compliance guarantee, the customer:
- benefits from a period of 2 years from the issuance of the property to act;
- can choose between the repair or replacement of the property, subject to the cost conditions provided for in article L 217-9 of the Consumer Code;
- is exempt from reporting proof of the existence of the lack of conformity of the property during the 24 months following the delivery of the property.
When it acts as a legal guarantee of hidden defects, the customer can choose between the resolution of the sale or the reduction of the sale price in accordance with article 1644 of the Civil Code.
